GENERAL COMMERCIAL TERMS AND CONDITIONS

By using the application you agree to these terms and conditions. Please read these terms and conditions carefully. If you do not agree with them, please do not use the application. We reserve the right to amend or modify our terms and conditions, to supplement them or remove a part of the terms and conditions, and to do so at our own discretion, in that we will publish the amended terms and conditions at our website. You confirm your agreement with the updated terms and conditions by continuing to use our services.

I. Opening provisions

These Commercial Terms and Conditions apply to use of the “Steve and Maggie” application, which is available, for example, at App Store or Google Play (hereinafter referred to as the “Application”), operated by the company Wattsenglish Ltd., Manchester Salford, Bexley Square 6, M3 6BZ, Great Britain, Company Number: 059 34 287, registered at Companies House, Cardiff, Great Britain, under number 5934287, acting within the territory of the Czech Republic through its subdivision Wattsenglish Ltd., Czech Republic branch, organizační složka, having its registered office at: Liberec 14, Ruprechtická 749/117, Postcode 460 14, Company Number: 273 11 414 , entered in the Commercial Register maintained at the Regional Court in Ústí nad Labem, file A 19013 (hereinafter referred to as the “WE”). The Commercial Terms and Conditions define in more detail and elaborate on the rights and obligations of WE and of its customers (hereinafter referred to as the “User”).

II. The establishment of a contractual relationship

A contractual relationship is established between WE and the User at the moment of generating access to the Application for the first time.

III. Security and protection of information

WE declares that it does not collect or process any personal data of the User.

IV. Using the Application

The Application is available online at Google Play, App Store, etc., and may be accessed from mobile devices with Internet access (and offline on a mobile device after installation).

The way in which the Application is displayed might vary slightly and certain functions of the Application might be limited depending on the device, software version and Internet browser being used.

Legal guardians are responsible for persons who do not have full legal capacity (eg.: children).

V. Changes to the Application

WE reserves the right to expand the Application to include new functions and to modify and change existing functions at any time. WE reserves the right to change the appearance of the Application.

VI. The rights and obligations of the User

All materials contained in the Application are protected by copyright, whereby WE is the sole owner of copyrights. The User may only use these materials for his/her own needs and does not have the right to provide them to third parties in electronic format or in printed format. If these rules are breached, WE reserves the right to immediately cancel the User’s access to the Application which does not restrict in any way the right of WE to seek compensation for damage.

The User takes note that the Application might contain advertisements for other WE products, or the products of other companies. WE does not permit any marketing or business activities via this Application, or the parts thereof, without written consent.

VII. Third-party services

Third-party services might be used when buying, installing or updating the Application, for example Apple iOS App Store or Google Play. These third-party services are subject to the relevant contractual terms and conditions of those third parties. The User needs to read carefully the terms and conditions of third parties since they constitute an agreement between them and the relevant provider of third-party services. WE is not accountable for the activity of such third parties.

VIII. Warranty conditions

User support: WE provides user support, handles warranty claims and deals with all communication with the User by e-mail at app@wattsenglish.com

Limitation of liability: WE is under no circumstances liable for any damage incurred by the User (or by persons who are in the position of legal guardian) directly or indirectly as a result of using the Application.

IX. Final provisions

These Commercial Terms and Conditions, in the wording presented at the WE website, enter into force on the day the User accesses the Application for the first time. By accessing the Application the User unreservedly accepts all provisions of the contractual terms and conditions and is definitively bound by them. In situations which are not regulated by these contractual terms and conditions, the relationship between the User and WE is governed by valid and effective legal regulations, in particular the law of the Czech Republic.
